These Terms of Use ("Terms") govern your access to and use of the website at bonolota-marble.com (the "Site"), operated by Bonolota ("Bonolota", "we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
About the Site
The Site is an informational website that presents our company and our applications. It does not itself provide the applications; each app is distributed through the relevant app store and governed by its own terms (see "Our apps and the app stores" below).
Eligibility
The Site is intended for a general audience and is not directed to children. By using the Site, you represent that you are old enough to form a binding contract in your jurisdiction, or that you use the Site under the supervision of a parent or guardian who agrees to these Terms.
Use of the Site
We grant you a limited, non-exclusive, non-transferable, revocable permission to access and use the Site for your personal, non-commercial use. You agree not to: use the Site in any way that violates applicable law or these Terms; copy, scrape, harvest, or systematically extract Site content except as expressly permitted; attempt to gain unauthorised access to, disrupt, or overload the Site or its infrastructure; introduce malware or interfere with the Site's security or operation; or misrepresent your identity or affiliation with us.
Our apps and the app stores
Links on the Site direct you to our applications on third-party stores, including the Google Play Store and the Apple App Store. Downloading and using an app is subject to that app's own terms and privacy policy and to the store's terms, including Apple's standard Licensed Application End User License Agreement and the Google Play Terms of Service. We are not responsible for the stores themselves. Please note that the Android versions of our apps are published by Bonolota, while the iOS versions are published on the Apple App Store by our partner, Helpal Inc., under a collaborative arrangement; each store listing identifies its publisher.
Intellectual property
The Site and its content — including text, graphics, logos, the Bonolota name and mark, product names, and design — are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited permission above, no rights are granted to you. Product and company names mentioned on the Site may be trademarks of their respective owners.
Third-party links and services
The Site may link to third-party websites and services we do not control, including app stores, our blog, and, in future, a separate site for our VPN product. We provide these links for convenience and are not responsible for third-party content, policies, or practices. Accessing them is at your own risk.
Disclaimers
The Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on it is complete or current.
Limitation of liability
To the maximum extent permitted by law, Bonolota and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Site. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify and hold harmless Bonolota from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Site or your breach of these Terms.
Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Changes to the Site and to these Terms
We may modify or discontinue the Site, in whole or in part, at any time. We may also update these Terms; when we do, we will revise the "Last updated" date and, for material changes, provide more prominent notice. Your continued use after changes take effect constitutes acceptance.
Termination
We may suspend or restrict your access to the Site at any time if you breach these Terms or for any lawful reason. Sections that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will survive.
Governing law and jurisdiction
These Terms are governed by the laws of Bangladesh, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts of Bangladesh, subject to any mandatory consumer-protection rights you have in your country of residence.
General
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the Site. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
